Terms and Conditions
For purchases via the Kroots® webshop
We want families to be able to order from Kroots with confidence. In these terms and conditions, we clearly explain how ordering, payment, delivery, warranty, and use of our products work.
1. Who are we?
The webshop is operated by Kroots BV, with registered office in Belgium.
Kroots is an audio storytelling studio that ignites worldly curiosity in children and limits their screen time.
- Company number / VAT number: BE1034.514.403
- Website: www.kroots.world
2. Scope of application
These terms and conditions apply to all purchases made directly through the Kroots webshop. By placing an order, the customer accepts these terms and conditions.
For purchases, subscriptions, or services via external platforms, marketplaces, or third-party app stores, such as Spotify, Bookbeat, Kobo, Storytel, or other distribution platforms, the terms of the relevant platform apply. Kroots cannot process refunds or cancellations for purchases made through such platforms.
3. Products and availability
Kroots develops and sells, among other things, audio stories, physical products such as audio cassettes, and related products. We do our best to present product descriptions, images, prices, availability, and delivery information as clearly and accurately as possible.
Small deviations in colour, finish, packaging or display may occur, among other things due to screen settings, production differences or the nature of limited-edition products. Such limited deviations do not constitute a defect if the product substantially corresponds to the description.
Some products may be offered in limited editions. If a product turns out to be unavailable after ordering, we will inform the customer as soon as possible and the amount paid will be refunded.
4. Prices, VAT and shipping costs
All prices on the webshop are displayed in euros and include VAT, unless expressly stated otherwise. Any shipping costs, delivery charges or other additional costs will be clearly stated before completing the order.
Kroots reserves the right to change prices. For already confirmed orders, the price displayed at the time of ordering applies, except in the case of obvious errors.
5. Order and payment
An order is placed via the Kroots webshop. The customer is responsible for correctly filling in the requested information.
The agreement is concluded as soon as the payment has been successfully completed and Kroots has confirmed the order by email. If a payment is not successfully completed, Kroots may cancel the order.
Payments are processed via the payment methods available on the webshop. Kroots does not process full payment card details when payments are made through an external payment provider.
6. Delivery
Kroots delivers to the address provided by the customer during the ordering process. The customer is responsible for correctly entering this address. If a package cannot be delivered due to an incorrect or incomplete address, or because the package is not picked up in time, additional shipping costs may be charged.
The stated delivery times are indicative, unless expressly agreed otherwise. Kroots makes reasonable efforts to dispatch orders on time. If there is a significant delay, we will inform the customer as soon as possible.
The risk of loss or damage passes to the consumer when the consumer or a third party designated by him takes physical possession of the goods.
7. Right of withdrawal, returns and refunds
Consumers have the right to withdraw from their purchase within 14 calendar days of receipt for online purchases, without giving any reason. The specific conditions, exceptions, and procedure are explained in the separate document “Return and refund policy”.
For sealed audio, video, or software products, including sealed audio cassettes, the right of withdrawal may lapse once the seal has been broken after delivery, to the extent permitted by law.
8. Legal warranty and non-conforming products
Consumers enjoy the legal warranty in accordance with Belgian consumer law. This warranty applies to conformity defects that exist at the time of delivery and that manifest within the legal warranty period.
If a product is defective or does not match the order, we ask the customer to contact us as soon as possible via orders@kroots.world, preferably with the order number, a brief description of the problem and, if useful, photos.
The statutory warranty does not affect other mandatory rights that the consumer has under applicable law.
9. Use of digital content and audio
When Kroots offers digital content or audio through its own webshop, this content may only be used for personal and non-commercial use within the family or personal circle of the customer, unless otherwise agreed in writing.
It is not permitted to copy, upload, distribute, resell, make publicly available or use commercially any audio, files, links, texts, illustrations or other Kroots content without permission.
10. Intellectual property
All names, logos, brands, characters, stories, texts, audio clips, illustrations, designs, product concepts and other content of Kroots remain the property of Kroots or its licensors. Nothing from the webshop or from the products of Kroots may be copied, modified, distributed or used commercially without prior written permission from Kroots.
11. Liability
Kroots strives to provide a reliable and secure webshop. However, Kroots cannot guarantee that the webshop is error-free or uninterrupted at all times.
Kroots is not liable for indirect damage, consequential damage, loss of profit or damage arising from improper use of products, except where liability cannot be excluded or limited by law.
Nothing in these terms limits the statutory rights of consumers.
12. Force Majeure
Kroots is not liable for delays or shortcomings resulting from circumstances beyond its reasonable control, such as disruptions in shipping services, technical problems, government measures, strikes, supply issues with suppliers, or other cases of force majeure.
13. Privacy
Kroots processes personal data in the context of orders, payments, delivery, customer service, and communication. More information on this can be found in Kroots' privacy policy.
14. Changes to these terms
Kroots may amend these general terms from time to time. The version applicable to an order is the version that was available at the time the order was placed.
15. Applicable law and disputes
Belgian law applies to these general terms. In the event of disputes, the competent courts of Belgium shall have jurisdiction, without prejudice to mandatory consumer rights that may apply in the country where the consumer resides.
For questions or complaints, we ask the customer to first contact us at orders@kroots.world, so that we can work together towards a reasonable solution..
